1.1 Call to Order

Mr. Thewlis, the JTC 1 TAG Chairman, called the meeting to order at 10:00 AM on Tuesday, October 1, 2002.

1.2 Membership and Attendance

1.2.1 Introduction of Attendees and New Members

The meeting participants were introduced. Guests in attendance were Ms. Marasco (ANSI), Dr. Hurwitz (ANSI), Mr. Podio (INCITS/M1 Chairman) and Mr. Rubinfeld (INCITS/L3 Chairman). The attendance list for the October 1-2, 2002 JTC 1 TAG Open Delegation meeting is available in Attachment 1.

1.2.2 Status of Members in Jeopardy for Failure to Attend Meetings (J. Garner)

At the August 2002 JTC 1 TAG meeting, no members were placed in jeopardy for failure to attend meetings.

Attendance at an open delegation meeting is mandatory only for members of the US delegation to the associated Plenary meeting. Since attendance is not mandatory at this meeting, Mr. Thewlis noted that no organization would be placed in jeopardy for failure to attend. Attendance at open delegation meetings will count towards the establishment or maintenance of a voting membership on the committee.

1.2.3 Membership Report (J. Garner)

Total voting membership on the JTC 1 TAG is 18. The attendance list for the October 1-2, 2002 JTC 1 TAG Open Delegation meeting is available in Attachment 1.

1.3 Approval of Draft Agenda, October 1-2, 2002

The third revised draft agenda (JT/02-0506) was approved as presented at this meeting by unanimous consent (Michael/Silletti).

2. Chairman's Remarks (D. Thewlis)

Mr. Thewlis, JTC 1 TAG Chairman, welcomed the JTC 1 TAG members in attendance.


3. Preparation for the October 21-25, 2002 JTC 1 Plenary - Sophia Antipolis, France (D. Thewlis)

3.1 For Action - Approval of Final US Delegation to the October 21-25, 2002 JTC 1 Plenary - Sophia Antipolis, France

At the August 2002 JTC 1 TAG meeting, the following individuals volunteered to serve on the US delegation to the October 2002 JTC 1 Plenary in Sophia Antipolis, France (JTC 1 N 6761):

Changes to the US delegation were discussed. Mr. Kisor (Intel) has indicated that he is unable to serve on the US delegation. Mr. Smith (US DoD) has requested to be added to the US delegation to the October 2002 JTC 1 Plenary. Following discussion, Mr. Thewlis reviewed the final US delegation:

The JTC 1 TAG approves the final US delegation to the October 2002 JTC 1 Plenary in Sophia Antipolis, France.

Vote on motion: Unanimous consent

The motion passes.

Action Item: The JTC 1 TAG Administrator will forward the final list of US delegates to the October 2002 JTC 1 Plenary in Sophia Antipolis, France to the JTC 1 Secretariat.

There will be a mandatory caucus of the US delegation on Sunday, October 20, 2002 at 5:00 PM. The US delegation will meet in the lobby of the Grand Hotel Mercure.

3.2 For Action - Review of October 2002 JTC 1 Plenary Agenda for Formulation of US Delegates' Instructions and US Positions

Mr. Thewlis explained that the last call plenary agenda (JTC 1 N 6889) would be reviewed for the preparation of US positions on plenary issues. The US delegates' instructions would be prepared as US positions are developed.

As is customary, the formulation of delegates' instructions is not captured in the minutes of JTC 1 TAG meetings. JTC 1 TAG members who would like to receive a copy of the final delegates' instructions for the October 2002 JTC 1 Plenary are asked to contact the JTC 1 TAG Administrator following the October 1-2, 2002 JTC 1 TAG Open Delegation meeting.

3.2.1 For Action - INCITS Executive Board Contribution on the Cultural and Linguistic Adaptability and User Interfaces (CLAUI) Technical Direction (TD)

The INCITS Executive Board contribution on the CLAUI Technical Direction ( JT/02-0459) was reviewed. The JTC 1 TAG agreed that the contribution was very similar to the other contributions submitted on the topic.

The JTC 1 TAG reviewed the proposed contribution prepared based upon discussion at this meeting:

U.S. Contribution on Technical Directions

The United States believes that JTC 1 should review the original purpose and the current results of creating Technical Directions within JTC 1 to determine if Technical Directions should be eliminated.

The United States believes that Technical Directions have not served JTC 1's purposes well. Technical Directions were originally intended as a marketing tool to explain JTC 1's program of work externally, and not as an additional layer of administration. The existence of Technical Directions as they have been implemented, however, in at least the case of the CLAUI TD has resulted in additional meetings, consumption of valuable resources which must come from the SCs themselves, has created disagreement between the member SCs, and allowed for turf battles between SCs within the TD. Furthermore, in the case of CLAUI, we feel that JTC 1 has repeatedly stated the position that attention to CLAUI issues is the responsibility of all JTC 1 Subcommittees in the development of their work.

The current implementation of Technical Directions can be better addressed with cross-SC coordination mechanisms and ad hoc groups at JTC 1 Plenaries if necessary, without the drain on JTC 1 and SC resources required to support the existence of the TDs. Finally, the marketing issues originally intended to be addressed by Technical Directions are better dealt with as a component of the Long Range Business Plan.

3.2.2 For Action - US Contribution on JTC 1/SC 29 IPR Issues

The JTC 1 TAG reviewed the various documents posted to this agenda item. Following discussion on October 1, 2002, Mr. Thewlis volunteered to draft a US contribution for consideration on October 2, 2002.

On October 2, 2002, the proposed US contribution to JTC 1 on the resolution of ISO/IEC IPR policy issues was reviewed:

U.S. Contribution to JTC 1 on Resolution of ISO/IEC IPR Policy Issues

A significant value of standardization within the ISO/IEC structure is the existence of ISO/IEC Policies governing the inclusion of Intellectual Property in standards. Our organizations and members accept and rely upon these established policies in deciding upon participation in JTC 1 Subcommittee and Working Group activities.

Given that the inclusion of Intellectual Property in standards is governed as a policy matter by ISO and IEC, Subcommittees and Working Groups cannot establish their own solutions to perceived shortcomings to the established ISO/IEC Policies, whether amplification or clarification. However, SCs and WGs do encounter such circumstances and JTC 1 must find a way to address these issues to further the technical work.

  1. The United States recommends that JTC 1 establish a mechanism for dealing with perceived IPR issues from Subcommittees and Working Groups:

    1.a When a Subcommittee or Working Group encounters a need for articulation or clarification of, extension to, or deviation from existing ISO/IEC Policy related to the inclusion of Intellectual Property in standards in the conduct of their technical work, the Subcommittee shall bring the issue to the JTC 1 Chairman and Secretariat.

    1.b. The JTC 1 Chairman and Secretariat are chartered to establish a mechanism with ISO and IEC to resolve these issues by taking them forward to ISO and IEC, and to ensure a response within six months.

    1.c Resolution to an issue, once determined, should be widely distributed to all Subcommittees and Working Groups.

  2. JTC 1 should direct its Subcommittees to refer existing and new concerns or issues relating to IPR to the JTC 1 Chairman and Secretariat for resolution in accordance with this mechanism.
  3. JTC 1 should direct its Subcommittees to immediately submit any existing documents or resolutions which attempt to articulate or clarify IPR policy to JTC 1 for consideration via the new IPR policy mechanism. In the interim, all Subcommittees shall act in accordance with approved ISO/IEC Policies.

Dr. Hurwitz, ANSI President, gave a brief report on his presentation to the September 2002 ISO Council meeting.

3.2.4 For Action - Determination of US National Body Comments on JTC 1 N 6857 - Request for Comments on The Delta Value of JTC 1 as a Provider of International Standards

It was agreed that the US would not submit formal comments in response to JTC 1 N 6857 - Request for Comments on The Delta Value of JTC 1 as a Provider of International Standards, as no JTC 1 TAG members had submitted comments.

4.1 Next Meeting - November 18-19, 2002
